Renting a privately-owned cottage for your vacation is different than staying in a hotel or inn. There are things you need to consider about renting this type of vacation property before finalizing your booking. While there are many benefits to renting private cottages (kitchens to prepare family meals, privacy, enhanced amenities in some cases, more space) you should be aware of some limitations, as well, especially if this is your first time renting one.

Please read these Terms of Service (“Terms”) carefully as they contain important information. By booking a stay at 1 Bloomfield Road, Bar Harbor, ME 04609 (“Summertime” or “The Property”) through this online booking platform, you (the “Guests”) agree to comply with and be bound by these Terms outlined by Rouhana and Karki, LLC (the “Owner).

BOOKINGS: To make a booking, an inquiry is required. No credit card or payment information is required to make an inquiry. To make an inquiry please enter your dates into the online platform and click book. All bookings are from Saturday to Saturday.

SMOKING: Smoking is not permitted at any cottage. Evidence of smoking inside a cottage will result in forfeiture of security deposit.

BASIC SUPPLIES: All houses are completely furnished. Summertime provides linens (sheets and towels), cookware, dining ware, basic cleaning supplies, and toilet paper. You may need to bring personal consumable items like personal soap, paper towels, napkins, and shampoo. More information provided at booking.

SAME CONDITION: Guests will keep The Property in as good repair and as clean as they found it at the outset of their stay (wear and tear arising from a reasonable use of the same, and damaged by the elements occurring without any fault or neglect of the Guests accepted), and at the expiration of their stay term agree to yield up the peaceable possession thereof to the owners. The Guests specially agree to assume financial responsibility for any damage or loss to the structure, furnishings or landscaping if damage is due to negligence or caused by the Guests or any members of their party. Cost of repair or replacement will be deducted from the Security Deposit and or billed as an extra if necessary. Please respect the contents, furnishings, environment, and treat them as you would your own property.

REPAIR: During the booked period of the stay the Guests are responsible for cleaning, replacement or repair of household effects and premises that are unusually soiled or damaged at the end of the stay, to satisfaction of Owners. Occasionally things break or break down in cottages, like appliances, furniture, etc. Unlike a hotel, there is no 24/7 maintenance staff. You will need to notify the owner immediately of an appliance malfunction and the owner will work to have things repaired as quickly as possible. Repair of a dishwasher or washer can take up to a few days. Broken furniture may require replacement and can take a couple days, also.

BROOM CLEAN: It is the Guests responsibility to leave the cottage in a "broom clean" condition, all dishes cleaned and put away, and the general condition of the property neat. The Guests are also responsible for any excess cleaning (over and above the usual time allocated for changing the cottage over) performed by cleaning staff after departure at a rate of $25.00 per hour.

SECURITY DEPOSIT: A credit hold in the amount of $300.00 will be placed on visitor credit card upon check-in. Security deposits are returned within one week after departure, less any damages.

PETS: Family pets are WELCOME with prior approval. A pet fee of $95 per pet is required. While most of us allow pets up on our own furniture at home, Summertime will not allow pets on the furniture. You must determine how you’re going to adhere to the pet rules, particularly when you’re out and about and your animal is at the cottage, alone. Also, in a new environment, animals can become frightened when left alone and may bark. Complaints made against the cottage due to your barking dog could lead to a police complaint and possible fines. And damage made by your pet (torn screens, chewed furniture, stained rugs) will be deducted from the security deposit. The Pet Fee does not include damage made by your pet. Please consider this as you are making your plans and arrangements for your animal. Note, there is animal day care in our area should you be out of the house for long stretches of time. Also, you must clean up your pet’s feces on the property before departure.

CANCELLATION: Aside from the 24-hour risk-free cancellation Grace Period, the Guests hereby agree that, upon booking at Summertime, and the making of the initial payment, should it become impossible for the Guests to occupy the premises due to no fault of the Owner, the amount paid shall be retained by the Owner as liquidated. The Guests shall be responsible to pay the balance due for the entire booked period. Should this situation arise, the Owner will try to rebook or sublease the premises and any Monies received through rebooking or subleasing will be returned to the initial Guests, subject to and not more than the original amounts paid under the payment schedules, less a $300.00 cancellation fee.

TERMINATION: We (the Owner) reserve the right to terminate the stay, if payments are not made on time and according to the payment schedule. Monies paid by the Guest will be refunded, only if the property can be released for the dates you (the Guests) had reserved, less the $300.00 cancellation fee.

CHECK-IN & CHECKOUT: Early Check-in is not, in most cases, possible. There is a short window for change-over cleanings and owners usually need the full amount of time. Check the condition of the property when you arrive. If something is broken or amiss, notify us so that you will you not be held responsible for it. An email or phone message is sufficient.

MAXIMUM OCCUPANCY: The maximum number of guests is limited to 8 persons.

MINIMUM STAY: This property requires a seven (7) night minimum stay with check-in on Saturday and checkout on a following Saturday. If a rental is permitted for less than 7 days, the guest will be charged the weekly night rate.

AGE RESTRICTIONS: There is a minimum age restriction of twenty-one (21) years for the principle client.

PROPERTY RATES AND PRICING: Rates subject to change without notice.

FALSIFIED BOOKINGS: Any booking obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

WRITTEN EXCEPTIONS: Any exceptions to the policies mentioned above must be approved in writing in advance.

PARKING: Parking is available free of charge.

INSURANCE: It is your responsibility to take out adequate travel insurance and cover for the duration of your trip.

INTERNET ACCESS: Summertime provides access to high-speed WIFI.

NEIGHBORHOODS/MUNICIPALITIES: Summertime is located in residential towns and villages. The owners of the cottages are not responsible for municipal work being done in the neighborhood, nor are they responsible for their neighbors’ activities (i.e. renovation construction, lawn mowing, church bells, etc). Refunds will not be given for disturbances outside the control of the owner.

UTILITY OUTAGES: Summertime is similar to your own house, in that power outages, cable TV outages, Internet outages, etc. are out of the control of the owner. We are all under the constraints and timelines of the local utility companies. If the cable TV goes out you will not be entitled to a partial refund on the rental if the outage is directly related to Time Warner Cable. And unfortunately, getting a service appointment on utility issues in our area can take up to 5 days or more. We ask that you be patient and not let an inconvenience like this disrupt the enjoyment of your vacation. In 2011 we had a power outage related to Hurricane Irene. Unfortunately, some guests were without power for a couple of days. ALL of us who live here were also out of power for a day or two. The cottage owners are not able to expedite restoring power, therefore will not refund renters any funds for this loss of a utility.

TAKE YOUR BELONGINGS: Owners are not responsible for items left behind. While we will make every effort to retrieve your left items, you will assume the cost of return shipping.

NUISANCE INSECTS: Maine, like many other areas of the country, is prone to seasonal nuisance insects like mosquitoes, black flies, horse flies and ticks. There are a number of applications, such as "Deep Woods Off" and "Deet", available to minimize the effects of these insects so you can thoroughly enjoy the outdoor activities that the area has to offer. We highly recommend you use them.

LIABILITIES and AMENITIES: You must take responsibility for your usage of Summertime facilities. It is at your own risk that you use them. Extra care should be taken with children and these facilities. It is important that you know your own limitations when it comes to hiking and biking and the proper safety equipment must be used.

RISK OF LOSS AND INDEMNIFICATION: Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any reason whatsoever. Guest hereby covenants and agrees to indemnify and hold harmless Rental Agent and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Rental Agent harmless in all such cases.

RELEASE: Guest hereby waives and releases any claims against Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.
